This Privacy Policy describes how ClarksRetailEdge LLC (“ClarksRetailEdge,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects personal information through its website, www.clarksretailedge.com (the “Site”), its booking system, and any related online interactions. By accessing or using the Site, you agree to this Privacy Policy.

 

This Privacy Policy does not govern any coaching or consulting Services delivered through a Master Services Agreement (“MSA”).

Service-related privacy practices are addressed in Article 8 of the MSA and Exhibit C (California Consumer Notice).

 

SECTION 1 — INFORMATION WE COLLECT

 

We collect the categories of personal information described below.

 

1.1 Information You Provide Directly

 

This includes:

•  Name, email address, business affiliation

•  Country and state of residence

•  Intake information, including KPIs or business metrics

•  Scheduling and booking details

•  Payment-related information submitted through Wix Payments or PayPal

•  Messages sent to us via the Site or email

 

You may choose not to provide certain information, but doing so may prevent us from reviewing or approving a Booking Request.

 

1.2 Information Collected Automatically

 

When accessing the Site, we and our service providers (including Wix and Google Analytics) may collect:

•  Device information and browser details

•  IP address and approximate geolocation

•  Session identifiers, Site performance data

•  Cookie activity (see Cookie Policy)

•  Interaction logs and page view behavior

 

1.3 Information Generated During Sessions

 

If a coaching Session occurs, the following may be generated:

•  Internal notes created by the Zoom AI Companion (confidential; not shared with Client except at Provider’s discretion)

•  Administrative summaries retained for continuity

 

These materials are not used for training AI models and are not shared outside ClarksRetailEdge.

 

1.4 Information From Third Parties

 

If you access the Site through a third party (such as Google), we may receive basic profile or authentication information as permitted by the provider.

 

SECTION 2 — HOW WE USE PERSONAL INFORMATION

 

We use personal information for the following purposes:

 

A.    reviewing Booking Requests and determining eligibility;

B.    maintaining Site operations, performance, security, and integrity;

C.    scheduling, confirming, or canceling appointments;

D.   processing payments through Wix Payments or PayPal;

E.    responding to inquiries and providing support;

F.     improving Site functionality and user experience;

G.   maintaining internal administrative and compliance records;

H.   creating anonymized or aggregated insights that cannot identify you.

 

ClarksRetailEdge does not use personal information for automated decision-making or profiling that produces legal or similarly significant effects, and no such decisions are made using AI Companion outputs or analytics tools.

 

We do not sell personal information and do not share it for cross-context behavioral advertising.

 

SECTION 3 — DISCLOSURE OF PERSONAL INFORMATION

 

We may disclose personal information to:

 

A.    service providers, including Wix, Zoom, Google, PayPal, analytics vendors, and cloud hosting providers;

B.    legal authorities when required by law, subpoena, or to comply with regulatory obligations;

C.    professionals (such as attorneys or accountants) when necessary to protect our rights;

D.   successors in interest in the event of a merger, acquisition, or organizational transition.

 

 

Service providers may process data in multiple jurisdictions.

 

SECTION 4 — DATA RETENTION

 

We retain:

•  Booking and intake data for approximately one year, unless needed longer for compliance;

•  Payment records for periods required by tax and accounting laws;

•  AI Companion notes for internal use for up to one year;

•  Emails and communications for recordkeeping, dispute resolution, or compliance.

 

 

SECTION 5 — DATA SECURITY

 

We use commercially reasonable physical, administrative, and technical safeguards to protect personal information.

However, no system is perfectly secure.

You are responsible for safeguarding your device, email access, and network environment.

 

SECTION 6 — INTERNATIONAL USERS

 

The Site is operated from the United States.

If you access the Site from outside the United States, you understand and agree that your personal information may be processed in the United States.

 

ClarksRetailEdge does not serve any residents of EU Member States or other Ineligible Jurisdictions (see MSA Exhibit B).

 

Access from such jurisdictions is prohibited

 

 

SECTION 7 — YOUR RIGHTS

 

Depending on your jurisdiction (including California), you may have the right to:

•  access your personal information;

•  request correction of inaccurate information;

•  request deletion of personal information;

•  request information about categories of data collected;

•  opt out of certain data-sharing practices;

•  appeal a denied request.

We may require verification of your identity.

 

SECTION 8 — CHILDREN’S PRIVACY

 

The Site is intended only for users aged 18 or older.

We do not knowingly collect data from children under 18.

 

 

SECTION 9 — CHANGES TO THIS PRIVACY POLICY

 

We may update this Privacy Policy from time to time.

Material changes will be reflected by updating the “Last Updated” date.
